Mediation Fees and Policies

 

Effective May 1, 2004, Heather Fitzenhagen of Resolution Strategies, LLC will assess fees and costs according to the following schedule:

  1. Hourly Rates– For time spent on preparation, attendance at mediation and any follow up activity in furtherance of the mediation (e.g. telephone negotiations, preparation of reports, resolution of settlement agreement issues, etc.):
    • $350 per hour for all matters

    A four (4) hour minimum shall be charged for all mediations.
  2. Travel Policy
    1. No travel time will be charged for mediations within Florida unless the one-way travel time from Fort Myers, Florida to the mediation location exceeds four (4) hours.
    2. Mediations that take place outside the State of Florida or exceed the four (4) hour travel time limitation shall be charged travel time at the rate of $150.00 per hour, unless a flat rate is negotiated prior to the commencement of the mediation. Travel costs such as airfare and hotels will be charged when appropriate.
  3. Special Circumstances – Rates are negotiable, upwards and downwards, for special circumstances, including need.
  4. Responsibility for Mediation Fees – Unless otherwise notified, it will be assumed that Counsel for each side will be responsible for one-half the charges. A deposit of $600.00 from each party is requested at the time the mediation is scheduled
  5. Mediation Materials and Confidential Mediation Summaries — All pleadings, pending dispositive motions and prior judicial determinations in the matter at issue should be submitted in the form of a joint exhibit by all counsel at least one week prior to the mediation. Confidential mediation summaries are not required but any such summary should be provided two days prior to the mediation and should contain such information and exhibits as counsel believe may help crystallize the issues, describe settlement discussions and positions, or otherwise aid the mediator in attempting to facilitate a resolution of the dispute.
  6. Cancellation Policy – Notice of cancellation of a scheduled mediation must be given no less that forty-eight (48) hours in advance of the mediation date. If the mediation is cancelled less than forty-eight (48) hours in advance of the mediation date, a cancellation charge of $600.00 shall be assessed.
